How Does Speeding Cause Boat Accidents?

BoatSpeed

There are many different causes of boating accidents but by far one of the most common is speeding. When boat operators speed on Florida’s waterways, it can cause serious accidents that result in the most severe injuries. While it is true that there are no speed limits on open water, generally speaking, the state does regulate boat speeds in certain areas to protect boaters.

When these speed limits are violated, or people operate their boat at too great a speed for conditions, they may face criminal consequences. If you have been hurt by a boat operator who was speeding, you may be able to file a claim for compensation against them. Below, our Florida boat speeding accident lawyer explains further.

Why is Speeding on a Boat So Dangerous?

Speeding on Florida’s waterways poses many dangers. The three biggest hazards this behavior creates are as follows:

  • Increased risk of accidents: Operating a boat at high speeds increases the risk of an accident occurring significantly. Speeding results in boat operators having less time to react to other vessels, instances, and water conditions. This not only places the speeding boat at risk of being involved in a crash, but nearby vessels, as well.
  • Increased severity of accidents: Speeding not only causes boat accidents, but it also increases the impact and severity of them, as well. When boats are traveling at a slow speed and collide, it may not result in serious injuries or even significant property damage. A crash at high speeds, though, will most likely result in extensive injuries and property damage, and even fatality.
  • Reduced maneuverability: Speeding limits the maneuverability of a boat, making it difficult for operators to avoid hazards, navigate turns, and respond to sudden environmental conditions. Boats will take longer to change direction when they are speeding and so, this can also result in a crash.

Filing a Claim Against Speeding Boat Operators

The Florida Fish and Wildlife Conservation Commission (FWC) regulates and enforces speed limits in a number of waterways to protect the safety of everyone on the water. Violations can incur penalties such as fines and suspension of boating privileges, but these do not help accident victims.

In order to obtain compensation from a speeding boat operator for your medical expenses, lost income, and more, you must file a personal injury claim against them. When filing a personal injury claim, you must prove that the other party was negligent, or careless, and caused a crash that resulted in your injuries. When the liable party violated certain laws or regulations, you may be able to file a claim based on negligence per se. This means you do not have to prove the liable party was negligent, only that they violated the law and you were injured as a result.
